Welcome to www.eZkrt.com ("Site"). The owner and operator of the Site is One Pi General Trading L.L.C., a limited liability company registered in the United Arab Emirates ("UAE") under license number 953366, with its office located at WHP2-BLOCK-A COMMERCIAL ("we", "our" or "us"). 

These Terms of Use and all associated policies and additional terms (if applicable) displayed on the Site delineate the conditions under which we grant you access to and usage of our Site, services, and applications, including our mobile application (collectively, the "Services"). All our policies and additional terms can be found here: www.ezkrt.com ("Legal Documents"). These Legal Documents are integrated into these Terms of Use by reference. 

By accessing, registering, and/or continuing to use or access our Services, you are consenting to be bound by these Terms of Use and the Legal Documents immediately. These Terms of Use and the Legal Documents are susceptible to modification by us at any juncture. Your ongoing utilization of the Site after any such modification constitutes your acceptance of these Terms of Use and Legal Documents as so revised. 

Instances of "you" (or similar) in these Terms of Use pertain to you either as an individual or as a legal entity, as applicable. 

eZkrt is a marketplace that allows users to offer, sell and buy just about anything in a variety of pricing formats and locations. The actual contract for sale is directly between the seller and buyer. eZkrt is not a party to the transaction, and it is not a seller or a traditional auctioneer.

Any guidance we provide as part of our Services, such as pricing, shipping, listing, and sourcing is solely informational and you may decide to follow it or not. Also, while we may help facilitate the resolution of disputes through various programs, eZkrt has no control over and does not guarantee: the existence, quality, safety or legality of items advertised; the truth or accuracy of users' content or listings; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

These terms and conditions govern your use of our website (our "Platform"), software and applications provided by us (collectively, our "Platform").Please read these terms carefully before you submit any order on our Platform. These terms tell you who we are, the conditions on which you may be a seller or a buyer on our Platform, what to do if there is a problem, and other important information. Please note that your use of the Website service constitutes your unconditional agreement to follow and be bound by these terms and conditions (the “Terms and Conditions”).. If you are using our Platform as a representative of an entity you are agreeing to these terms on behalf of that entity.

Subject to Applicable Law, eZkrt may, in its discretion, from time to time amend or otherwise modify the Terms & Conditions. eZkrt recommends that you carefully read the Terms and Conditions each time you visit the Website as the Terms & Conditions may affect your rights.

If you do not agree to (or cannot comply with) any of the Terms and Conditions, do not use this Website.

1. Website

Your use of the Website and services and tools are governed by the following terms and conditions as applicable to the Website including the applicable policies which are incorporated herein by way of reference. Use of the Website shall subject You to the policies that apply to the Website. By mere use of the Website, You shall be contracting with eZkrt and these terms and conditions including the policies constitute your binding obligations, with eZkrt.

When you use any Materials provided by us through the Website you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such services, and they shall be deemed incorporated into the T&C and considered a part and parcel of the T&C. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of the T&C at any time and without any prior written notice to you. It is your responsibility to review the T&C periodically for updates/changes. Your continued use of the Website following the changes will mean that you accept and agree to the revisions. As long as you comply with the T&C, we grant you a personal, non-exclusive, non-transferable, and limited privilege to enter and use the Website.

ACCESSING, BROWSING, OR OTHERWISE USING THE WEBSITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS, SO PLEASE READ THE TERMS CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these T&C, You also accept and agree to be bound by eZkrt Policies (including but not limited to Privacy Policy available on Privacy Policy as amended from time to time.

2. Website Security

You are prohibited from violating the security of the Website, including, without limitation,

• accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access;
• attempting to probe, scan or test the exposure of a system or network or to breach security or authentication measures without proper authorization;
• attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Website, overloading, flooding, spamming, mail bombing or crashing;
• sending unsolicited email, including promotions and/or advertising of products or services.

Violations of system or network security may result in civil or criminal liability. We will investigate such violations and prosecute users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Website or any activity being conducted on this Website. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Website other than the search engine and search agents available from us on this Website. Access to the Website may be occasionally restricted to allow for repair, maintenance or the introduction of new facilities or services.

3. Terms of Use

Use of the Website is available only to persons who can form legally binding contracts under the applicable laws. Persons who are “incompetent to contract” including minors, un-discharged insolvents, etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the Website and shall not use the website. As a minor, if you wish to use the website, such use may be made by your legal guardian or parents on the Website. We reserve the right to terminate your registration and/or refuse to provide you with access to the Website if it is brought to eZkrt’s notice or if it is discovered that you are under the age of 18 years.

The Website cannot be accessed to persons whose registration has been suspended or terminated by us for any reason whatsoever. Those who choose to access this Website from outside the United Arab Emirates are responsible for compliance with local laws if and to the extent local laws are applicable. We will deliver the products only within the UAE and will not be liable for any claims relating to any products ordered from outside its jurisdiction.

4. Your Account and Registration Obligations

The information (the “Information”) provided from your end will be protected in accordance with our Privacy Policy. If You use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this T&C, We shall have the right to indefinitely suspend or terminate or block access of your registration on the Website and refuse to provide You with access to the Website.

We assume no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your password or account. Any suspicious activities on your account shall be notified to us by contacting us immediately through the address provided below. If we have reason to believe that there is likely to be a breach of security or misuse of the Website, we may require you to change your password or we may suspend your account without any liability to us.

5. Communications

Membership on the Website is free for buyers. eZkrt does not charge any fee for browsing and buying on the Website. eZkrt reserves the right to change its Fee Policy from time to time. In particular, it may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event eZkrt reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in UAE Dirham. You shall be solely responsible for compliance with all applicable laws including those in UAE for making payments to eZkrt.

6. Charges

Membership on the Website is free for buyers. eZkrt does not charge any fee for browsing and buying on the Website. eZkrt reserves the right to change its Fee Policy from time to time. In such an event eZkrt reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Unless otherwise stated, all fees shall be quoted in UAE Dirham. You shall be solely responsible for compliance with all applicable laws including those in UAE for making payments to eZkrt.

7. Platform for Transaction and Communication

The Website is a platform that Users utilize to meet and interact with one another for their transactions. eZkrt is not and cannot be a party to or control in any manner any transaction between the Website's Users.

Henceforward:

1. All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. eZkrt does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.
2. eZkrt does not make any representation or Warranty as to specifics (such as quality, value, salability, etc) of the products or services proposed to be sold or offered to be sold or purchased on the Website. eZkrt does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Website. eZkrt accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
3. eZkrt is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers. eZkrt cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Website. It shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.
4. eZkrt does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc) of any of its Users. You are advised to independently verify the bona fides of any particular User that You choose to deal with on the Website and use Your best judgment in that behalf.
5. eZkrt does not at any point of time during any transaction between Buyer and Seller on the Website come into or take possession of any of the products or services offered by Seller nor does it at any point gain title to or have any rights or claims over the products or services offered by Seller to Buyer.
6. At no time shall eZkrt hold any right, title or interest over the products nor shall eZkrt have any obligations or liabilities in respect of such contract entered into between Buyers and Sellers. It is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of products which are out of stock, unavailable or back ordered.
7. The Website is only a platform that can be utilized by Users to reach a larger base to buy and sell products or services. eZkrt is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Seller and the Buyer.
8. You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the seller(s) that You transact with.
9. You release and indemnify eZkrt and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Website and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, eZkrt cannot take responsibility or control the information provided by other Users which is made available on the Website. You may find another User's information to be offensive, harmful, inconsistent, inaccurate, or deceptive. Please use caution and practice safe trading when using the Website

Please note that there could be risks in dealing with underage persons or people acting under pretense.:

8. Use of Website

You agree, undertake and confirm that Your use of the Website shall be strictly governed by the following binding principles:

   3. is misleading in any way;
   4. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
   5. harasses or advocates harassment of another person;
   6. involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”;
   7. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;
   8. infringes upon or violates any third party’s rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address or phone number) or rights of publicity];
   9. promotes an illegal or unauthorized copy of another person’s copyrighted work (see “Copyright complaint” below for instructions on how to complain about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
   10. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
   11. provides material that exploits people in a sexual, violent, or otherwise inappropriate manner or solicits personal information from anyone;
   12. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
   13. contains video, photographs, or images of another person (with a minor or an adult).
   14. tries to gain unauthorized access or exceeds the scope of authorized access to the Websiteor profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
   15. solicits gambling or engages in any gambling activity which We, in Our sole discretion, believes is or could be construed as being illegal;
   16. interferes with another User’s use and enjoyment of the Website or any other User’s enjoyment of similar services;
   17. refers to any website or URL that, in Our sole discretion, contains material that is inappropriate for the Website or any other website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use.
   18. harm minors in any way;
   19. infringes any patent, trademark, copyright, or other proprietary rights or third party’s trade secrets or rights of publicity or privacy;
   20. violates any law for the time being in force;
   21. deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing;
   22. impersonate another person;
   23. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information;
   24. threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
   25. shall not be false, inaccurate, or misleading;
   26. shall not create liability for Us or cause Us to lose (in whole or part) the services of Our internet service provider (“ISPs”) or other suppliers;
2. You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or another automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve Our right to bar any such activity.
3. You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or any server, computer, network, or to any of the services offered on or through the Website, by hacking, password “mining” or any other illegitimate means.
4. You shall not probe, scan or test the vulnerability of the Website or any network connected to the Website nor breach the security or authentication measures on the Website or any network connected to the Website. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to Website, or any other customer, including any account on the Website not owned by You, to its source, or exploit the Website or any service or information made available or offered by or through the Website, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your information, as provided for by the Website.

You shall not make any negative, denigrating, or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us or otherwise engage in any conduct or action that might tarnish the image or reputation, of eZkrt or its associate companies or sellers on the platform or otherwise tarnish or dilute any eZkrt’s trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website or eZkrt’s systems or networks, or any systems or networks connected to eZkrt.
6. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Website, or with any other person’s use of the Website.
7. You may not forge headers or otherwise manipulate identifiers to disguise the origin of any message or transmittal You send to Us on or through the Website or any service offered on or through the Website. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.
8. You may not use the Website or any content for any purpose that is unlawful or prohibited by these Terms & Conditions or to solicit the performance of any illegal activity or other activity which infringes the rights of eZkrt and/or others.
9. You shall at all times ensure full compliance with the applicable laws as amended from time to time.
10. Solely to enable Us to use the information You supply Us with so that we are not violating any rights You might have in Your Information, You agree to grant Us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights or any other rights You have in Your Information, in any media now known or not currently known, concerning Your Information. We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the content You provide. You agree that any content You post may be used by us, consistent with Our Privacy Policy and Rules of Conduct on Site as mentioned herein, and You are not entitled to any payment or other compensation for such use.
11. You shall not engage in advertising to or solicitation of, other Users of the Website to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the www.eZkrt.com or related to us. You may not transmit any chain letters or unsolicited commercial or junk emails to other Users via the Website. It shall be a violation of these T&C to use any information obtained from the Website to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to another person other than Us without Our prior explicit consent. You understand that We have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Website) as necessary to satisfy any law, regulation, or valid governmental request. This may include, without limitation, disclosure of the information in connection with an investigation of alleged illegal activity or solicitation of illegal activity or response to a lawful court order or subpoena. In addition, We can (and You hereby expressly authorize Us to) disclose any information about You to law enforcement or other government officials, as we, in Our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.We reserve the right, but have no obligation, to monitor the materials posted on the Website. We shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these T&C. Notwithstanding this right, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST ON THE WEBSITE AND IN YOUR PRIVATE MESSAGES. Please be advised that such Content posted does not necessarily reflect eZkrt views. In no event shall eZkrt assume or have any responsibility or liability for any Content posted or for any claims, damages, or losses resulting from the use of Content and/or appearance of Content on the Website. You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libelous, tortious, or otherwise unlawful information.
12. It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Website and that You may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about You due to your use of the Website, and that the recipient may use such information to harass or injure You. We do not approve of such unauthorized uses, but by using the Website You acknowledge and agree that We are not responsible for the use of any personal information that You publicly disclose or share with others on the Website. Please carefully select the type of information that You publicly disclose or share with others on the Website.
13. We shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).

9. Posting on the Website

eZkrt does not claim ownership of the materials You provide to us (including feedback and suggestions) or post, upload, input or submit to any section of the Website, (each a “Submission” and collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting (“Posting”) Your Submission You are granting eZkrt, its affiliated companies and necessary sub-licensees permission to use Your Submission in connection with the operation of their business, including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat Your Submission; to publish Your name in connection with Your Submission;and the right to sublicense such rights to any other party.

You hereby acknowledge and agree that no compensation shall be paid or no future commercial consideration has accrued concerning the use of Your Submission by eZkrt, as provided herein. eZkrt shall be under no obligation to post or use any Submission You may provide and eZkrt shall remove any Submission at any time at its sole discretion.

By Posting a Submission You hereby warrant and represent that You own or otherwise control all of the rights required under worldwide law for Your Submission as described in these Terms of Use including, without limitation, all the rights necessary for You to provide, post, upload, input or submit the Submissions.

10. Orders & Acceptance of Orders

We reserve the right, at its sole discretion, to refuse or cancel any order for any reason whatsoever. When you make an order, you are making an offer to purchase, and such offer is subject to acceptance of eZkrt. Your receipt of an order confirmation from eZkrt does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. eZkrt may require additional verifications or information before accepting any order. Your order is not accepted until eZkrt sends you shipping information for the order (or the accepted portion thereof). Notwithstanding the foregoing, you agree that, if eZkrt cancels all or a part of your order, your sole and exclusive remedy is either that (a) eZkrt will issue a credit to your credit/debit card or bank account in the amount charged for the canceled portion (if your account card has already been charged for the order) or (b) eZkrt will not charge your credit/debit card or bank account for the canceled portion of the order.

For your convenience, eZkrt accepts Visa, Master Card, Diners Club and American Express. Notwithstanding anything contained herein, any payments made vide the abovementioned options, either through payment gateway on the eZkrt website or through eZkrt mobile application, are subject to specific terms and conditions of such third party payment gateways.

It is the responsibility of the customer to ensure that they are present at time of delivery.

11. Order Cancellation

We may cancel your order(s) if:

• you do not make any payment to us when it is due;
• you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products; or
• you do not, within a reasonable time, allow us to deliver the products to you or collect them from us; or
• you attempt to bulk or multi-order purchase
• order(s) not being capable of fulfilled due to product(s) not being available.

We will not cancel or change orders already in process at the supplier, en route, or delivered. No change in delivery instructions will be entertained by us before 2 working hours of the time of delivery and acknowledged by our Customer support team (domestic). We will not cancel any order unless informed 24 hours before the delivery date.

Notwithstanding anything contained herein the Terms and Conditions, any Discount Voucher issued to you by eZkrt can be used only once and will expire thereafter, even if the order/delivery is unsuccessful.

Cancellations by the Customer

If cancellation notice from your side is duly received by us and the order has not been processed/approved by us, we shall cancel the order and refund the entire amount to your credit/debit card.

Orders that are cancelled after they have been shipped are subject to a AED 40 cancellation fee or applicable fee to be deducted from your refund for shipping and processing. We have the full right to demonstrate whether an order has been shipped or not. The customer agrees not to dispute the decision made by us and accept our decision regarding the cancellation.

12. Quantity Limits and Dealer Sales

We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. The said limitations may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. We also reserve the right, at its sole discretion, to prohibit sales to dealers or resellers. For purposes of these Terms and Conditions, reselling shall be defined as purchasing or intending to purchase any product(s) from eZkrt.com for the purpose of engaging in a commercial sale of that same product(s) with a third party.

13. Order-Related E-mails

Shortly after you place an order, you will receive an Order Confirmation e-mail which will include all the details of your order, including the order number, (required in the event you need to contact eZkrt). To show our appreciation, you will receive a confirmation e-mail from eZkrt when your order has been delivered.

14. Payment Terms

For each product or service you order on the Website, you agree to pay the price applicable for such product or service as of the time you submitted your order (“Product Price”), the delivery fees for the delivery service you select, if any (“Delivery Fees”), and any applicable taxes.

15. Mode of making payment

“We accept payments online using Visa and MasterCard credit/debit card in AED (or any other currency agreed)”.

16. Credit/Debit Card Information

We reserve the right to refuse to accept the Credit/Debit Card or, in such case the transaction is accepted, cancel the transaction, at our sole discretion, as part of our own fraud detection program.
